Η Κυπριακή και Ευρωπαϊκη Νομοθεσία για την Ασφάλεια και Υγεία στην Εργασία. Σύντομο σημείωμα από τον Εισηγητή.
Στόχος του προγράμματος είναι η ενημέρωση για τα βασικά σημεία / στοιχεία της Νομοθεσίας για την Ασφάλεια και Υγεία στην Εργασία, όπως ισχύει σήμερα στη Κύπρο. Η εις βάθος γνώση και εξοικείωση με τη Νομοθεσία είναι μια διαδικασία που χρειάζεται χρόνο και τριβή και σίγουρα δε μπορεί να είναι ο αντικειμενικός στόχος ή προσδοκίες από το πρόγραμμα αυτό.
Με την ολοκλήρωση του προγράμματος αναμένεται από τους συμμετέχοντες να είναι σε θέση να συνδέουν τα διάφορα θέματα ή κινδύνους ή καταστάσεις στους χώρους εργασίας με τους αντίστοιχους Νόμους ή Κανονισμούς. Εφόσον επιτευχθεί τούτο, θα μπορούν κάθε φορά να ανατρέχουν στους κατάλληλους Νόμους και Κανονισμούς για να αντλήσουν τις πληροφορίες ή προδιαγραφές ή υποχρεώσεις που επιβάλλει η Νομοθεσία.
Βεβαίως, τα εφόδια που θα αποκτηθούν συνιστούν το πρώτο βήμα μιας μεγαλύτερης πορείας που θα χρειαστεί σοβαρή δέσμευση και συστηματική ενασχόληση με το αντικείμενο, ώστε να μπορεί κάποιος να υποστηρίξει ότι <<Ναι, ανήκω στους Επαγγελματίες της Εργασιακής Ασφάλειας και Υγείας>>. Στο τέλος της πορείας, θα έχετε την ικανοποίηση ότι δεν εξασκείτε απλώς ένα επάγγελμα αλλά λειτούργημα.
2. Σύντομη Ιστορική αναδρομή.
Στη Κύπρο, η Υπηρεσία ή ο Φορέας που είναι επιφορτισμένος με την εφαρμογή της Νομοθεσίας για την Ασφάλεια και Υγεία στην Εργασία είναι το Τμήμα Επιθεώρησης Εργασίας, που υπάγεται στο Υπουργείο Εργασίας και Κοινωνικών Ασφαλίσεων.
Η διευθέτηση αυτή δεν είναι ίδια σε όλες τις χώρες της Ευρωπαϊκής Ένωσης. Υπάρχουν χώρες με παρόμοια συστήματα (Ελλάδα, Μάλτα) και χώρες με διαφορετικά συστήματα (Αγγλία, Ιρλανδία). Η Νομοθεσία όμως είναι παρόμοια αφού υπάρχει η υποχρέωση όλων των χωρών της Ευρωπαϊκής Ένωσης να εναρμονίσουν τη Νομοθεσία τους με τις σχετικές Οδηγίες.
Η πρώτη Νομοθεσία που εισήχθη στη Κύπρο και που αποσκοπούσε στη προστασία της Ασφάλειας, Υγείας και Ευημερίας των εργοδοτουμένων ήταν ο περί Εργοστασίων Νόμος Κεφ. 134 που τέθηκε σε εφαρμογή το 1956. Ήταν αρκετά περιεκτικός για τα δεδομένα της εποχής, έγιναν κατά καιρούς διάφορες τροποποιήσεις και εκδόθηκαν αρκετοί Ειδικοί Κανονισμοί για να μπορέσει να καλύψει τις εξελίξεις, και μέχρι το 1996 αποτελούσε τον βασικό κορμό της Νομοθεσίας.
Για καθαρά ιστορικούς λόγους, σημειώνεται ότι προϋπήρξαν από το 1947 κάποια Νομοθετήματα που αποσκοπούσαν στη προστασία των εργαζομένων αλλά ασχολούνταν με επί μέρους θέματα όπως οι ασφάλεια ατμολεβήτων και δοχείων πίεσης.
Η ιστορική αλλαγή έγινε το 1996 με τη ψήφιση του περί Ασφάλειας και Υγείας στην Εργασία Νόμου Ν.89(1)96 που τέθηκε σε ισχύ την 1/1/97. Τα επόμενα λίγα χρόνια ακολούθησαν μικρές τροποποιήσεις όπως το 2001 το 2002 το 2003. Το 2011 έγιναν νέες – σημαντικές τροποποιήσεις και σήμερα ο τίτλος της νομοθεσίας είναι: Οι περί Ασφάλειας και Υγείας στην Εργασία Νόμοι του 1996 έως 2011.
Ο πιο πάνω Νόμος είναι πλήρως εναρμονισμένος με τη πράξη της Ευρωπαϊκής Κοινότητας «Οδηγία 89/391/ΕΟΚ» και σκιαγραφεί ή οριοθετεί βασικά Πλαίσια και Αρχές, χωρίς να υπεισέρχεται σε λεπτομέρειες. Στα χρόνια που ακολούθησαν εκδόθηκαν μια πληθώρα Κανονισμών για ειδικά θέματα και σήμερα μπορεί να λεχθεί ότι η ισχύουσα Νομοθεσία είναι σε αρκετό βαθμό πλήρης και επαρκής, ώστε να εξυπηρετεί τους σκοπούς και τους στόχους που τέθηκαν.
